Finding and Growing New Markets Contest
FUJIFILM BUSINESS BUILDERS
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
Entry Conditions: This contest is open only to the owners and employees, on behalf of their employing company, of Independent Photo Labs, Photo Studios or Retail Stores with photo processing capabilities who are legal residents of the 50 United States or D.C., and who are at least 21 years old. Limit three (3) entries per company. Void in Puerto Rico and where prohibited. Subject to all applicable laws.
Employees of Sponsor of this contest as set forth below (“Sponsor”), any affiliate of Sponsor, any of its advertising or promotional agencies or any business or entity involved in the development, production, implementation, administration or fulfillment of this contest, any competitors of Sponsor and the immediate family members of any of the above (meaning spouses, parents, siblings and children living in the same household) are not eligible to enter or win.
Entry Timeframe: Contest begins April 7, 2011, 12:00:01 a.m. Eastern Time and ends June 30, 2011, 11:59:59 p.m. Eastern Time.
How to Enter: Access the contest entry form at www.photobusinessbuilders.com/entry-form/. Submit an idea in 500 words or fewer on the contest's theme: Finding and Growing New Markets. Idea(s) must be written in English. Ideas over 500 words will be disqualified. You must be the original author of the idea that you submit. A complete entry must include your name, company name, company address, email address, telephone number and idea description. You may enter up to three (3) different entry forms but there is a limit of one prize per company.
Entries must be received by the Sponsor by 11:59:59 p.m. Eastern Time on June 30, 2011, when the contest ends. Proof of submission is not proof of receipt. Sponsor’s computer is the official time-keeping device for this contest. All information provided by you to Sponsor becomes the sole property of the Sponsor upon submission. Entries without complete information will be disqualified. All late, lost, or incomplete entries are not valid entries. Any form of entry other than as expressly specified in these rules (including but not limited to automated, copied, third-party or mechanically reproduced entries) is prohibited and will be disqualified. Sponsor may collect personal data about you when you register and enter the contest. Please review the Sponsor’s applicable privacy policies available at http://www.fujifilmusa.com/privacy/index.html. By participating in the contest, you agree to all of the terms and conditions of the Sponsor’s applicable privacy policies and by entering you agree to be bound by these Official Rules and that the decisions of the Sponsor’s judges shall be final and binding in all respects. The Official Rules will be posted at the contest website throughout the contest.
Sponsor: FUJIFILM North America Corporation, 200 Summit Lake Drive, Valhalla, NY 10595.
Prizes: One (1) Grand Prize: $2,500 for use solely in business building programs: including, but not limited to, payment towards purchase of any equipment or consumables offered by the Imaging Division of FUJIFILM North America Corporation; website search engine optimization consulting; retail store makeover and/or displays; print, television, radio, direct mail, email or keyword search advertising; and/or new product templates and software.
Two (2) First Prizes: $1,000 for use solely in business building programs: including, but not limited to, payment towards purchase of any equipment or consumables offered by the Imaging Division of FUJIFILM North America Corporation; website search engine optimization consulting; retail store makeover and/or displays; print, television, radio, direct mail, email or keyword search advertising; and/or new product templates and software.
Prizes may not be substituted or transferred. All taxes and any other costs or expenses not expressly provided herein and associated in any way with the receipt of a prize are the sole and exclusive responsibility of each winner and the winner’s company. Allow 4-6 weeks after validation for receipt or arrangement of receipt of prize. You are not a contest winner until validated and you receive official notification from the judging organization and fully comply with all requirements as stated herein. No prizes or funds ultimately awarded as a result of this contest may be used to purchase merchandise or services from manufacturers or entities that are deemed, at Sponsor’s sole but reasonable discretion, to be competitors of FUJIFILM North America Corporation. All entrants agree to be fully bound by these Official Rules.
Each potential winner must complete and deliver to Sponsor an affidavit detailing how the company intends to use the funds in business building activities before any prize will be awarded. At Sponsor’s request, winners shall provide documentation, sufficient in form and substance, to reasonably confirm that prize funds awarded were actually disbursed by the winner according to the winner’s provided affidavit of intent and any funds not disbursed, in whole or in part, in keeping with the winner’s affidavit, or as otherwise approved in writing by Sponsor, shall be reimbursed to Sponsor in full by the winner. Sponsor further reserves the right to refuse to fund purchases by any winner from competitive manufacturers and entities.
Judging/Winner Selection: Winners will be selected by a panel of judges, in their sole discretion, using the following criteria: Creativity (25%); Potential for generating sales (50%); Easy to replicate (25%). Judging will be conducted between July 1, 2011 and July 31, 2011. Winners will be announced on or about August 1, 2011.
Validation: Contest materials and submissions are subject to validation by the judges. Potential winners will be contacted by phone, email or by overnight mail. In order to be deemed a winner, you may be required to complete, execute and return an affidavit confirming your identification and eligibility, a liability and publicity release, business building affidavit and an assignment of rights to your idea. You may also need to provide proof of your employer’s consent to entry into this contest. Failure to sign and return these forms at the Sponsor’s request may result in disqualification and selection of an alternate winner.
Any employee entering on behalf of his/her employer must have permission from his/her employer to enter the contest. The employees of any company selected as a contest winner must fully comply with his/her employer’s policies regarding acceptance of prizes.
General Conditions: All entrants hereby release and hold harmless Sponsor and its respective parent company, subsidiaries, affiliates, assignees and the advertising, direct marketing, research and promotions agencies, prize suppliers, and all of their respective employees, officers, directors, shareholder’s and agents (the “Contest Entities”) from any and all liability or any claims, injuries, loss or damage of any kind arising from or in connection with this contest, the use of any entry, or the acceptance of or use of any prize won, including but not limited to, any claims for infringement, defamation, invasion of privacy or right of publicity. The Contest Entities shall not have any liability for any indirect, special, punitive or consequential damages including without limitation loss of profits, opportunity or goodwill. The sole maximum liability of the Contest Entities shall be limited to the value of the prizes set forth herein.
By entering, you agree that your idea and all copyrights and other rights relating thereto become the property of Sponsor, which may edit, modify, publish, promote, use or not use any names and all materials submitted for any purpose, in any media worldwide, without additional compensation to you. By entering, you also agree that your name, address (city/state), images, likeness, statements and idea may be posted on the Sponsor’s website. Ideas must be your original work, may not have been published previously, must not infringe third-party rights, including trademark, copyright and right to privacy and publicity, and must be suitable for publication, as determined solely by Sponsor. By entering, you grant an unrestricted, irrevocable, exclusive license to Sponsor, Sponsor’s affiliates, partners and designees, and their respective agents and agencies, to publish, use, adapt, edit and/or modify your idea in any way, in any and all media worldwide, without limitation and without further compensation. By entering, you warrant and represent that you are the original author of the submitted idea, and that you have obtained any and all consent or permission necessary for Sponsor to publish or use your idea in any media worldwide, including but not limited to permission from any holder of copyrights, trademarks or other rights in materials or other items or persons depicted in your idea. You also agree to confirm any of the above in writing at Sponsor’s request.
Individual entries may be disqualified if the idea submitted with the entry contain materials that are trademarked, copyrighted by any person or entity other than you or your company, have been used or submitted elsewhere, or contain any obscene, defamatory or other offensive or inappropriate material as determined by Sponsor in its sole discretion. Sponsor reserves the right to disqualify any entries that Sponsor, at its sole discretion, determine to be inconsistent with its corporate standards, reputation or consumer expectations. No responsibility is assumed for lost, late, stolen or misdirected email or entries or any failure or unavailability of hardware, software, electronic communications or Internet or other connections. If integrity of the contest is compromised in any manner, Sponsor reserves the right to modify the contest and judge only entries received that are unaffected by the problem. Sponsor reserves the right to disqualify any person who attempts to tamper with the contest, harass or interfere with any other entrant, or otherwise acts in an inappropriate or unsportsmanlike way, all as determined by Sponsor in its sole and absolute discretion. Submissions shall be void if incomplete, not legible, or if they contain errors or do not comply strictly with all requirements in these rules. No submissions will be returned. No correspondence about submissions will be answered.

RIGHT TO CANCEL OR SUSPEND CONTEST:
If for any reason the contest is not capable of running as planned, whether due to infection by computer virus, bugs, phone line failure, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest, the Sponsor reserves the right, at its sole discretion, to disqualify any individual(s) who tampers with the entry process, and /or to cancel, terminate, modify, or suspend the contest.
GENERAL INFORMATION:
Unless prohibited by applicable law, Sponsor reserves the right to use any and all information related to the contest, including information on entrants obtained or submitted to Sponsor through or in connection with the contest (except for entrants from the State of Tennessee), for marketing purposes or any other lawful purposes.
NAME REMOVAL NOTIFICATION:
To be excluded from all future lists of names and addresses used by Sponsor to mail any contest offers or related materials, write your name and address on a piece of paper and mail it in an envelope to: Christine Deppe, FUJIFILM North America Corporation, 1800 Westwood Center Blvd., Suite 300, Wausau, WI 54401.
